End User License Agreement (EULA)

This End User License Agreement ("EULA") is an agreement between you and Mirko Bellabarba, an independent developer trading as MRK SOFTWARE. It governs your use of Choof, including its software, content, updates and related services (together, the "App"). By installing, accessing or using the App, you accept this EULA. If you do not accept it, do not install or use the App.

1. Relationship with the Terms of Service

This EULA supplements the App's Terms of Service. Mandatory applicable law prevails in the event of a conflict, and Apple App Store or Google Play terms govern their respective store services. Our Privacy Policy explains how personal data is handled.

2. Licence grant

Subject to this EULA, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for personal, non-commercial purposes. The licence does not transfer ownership of the App or any intellectual-property rights.

For the iOS version, the licence is limited to use on Apple-branded products that you own or control, in accordance with the Apple Media Services Usage Rules. For the Android version, it is limited to use on compatible devices under Google Play's terms.

3. Use restrictions

You may not copy, modify, adapt, sell, rent, sublicense, distribute or make the App available to others; reverse engineer it or attempt to extract its source code, except where the law expressly allows this; scrape or automatically extract data; bypass technical protections; or use the App to interfere with our systems or those of third parties. You must comply with applicable law and the terms of third-party services used with the App.

4. Rail data and third-party services

The App displays information about train timetables, status, location, stations, strikes and engineering works. This information comes from external sources, including the public ViaggiaTrenoAPIs, the information system of Trenitalia. MRK SOFTWARE is an independent project, with no affiliation, sponsorship or agreement with Trenitalia, Rete Ferroviaria Italiana (RFI) or Ferrovie dello Stato Italiane.

Information may be incomplete, out of date or temporarily unavailable, and is not a guarantee of departure, arrival or connection. Check the operator's official channels before travelling. Maps, push notifications, cloud infrastructure and other integrations may depend on third-party services outside our complete control.

5. Store services and in-app purchases

Apple App Store and Google Play are operated by their respective providers. Any in-app purchases are processed exclusively through the applicable store under its terms, pricing, payment procedures and refund rules. We do not receive or process data from your payment instruments.

6. Intellectual property

The App's code, graphics and original text belong to MRK SOFTWARE or are used with the necessary rights. Third-party trademarks and content, including those relating to Trenitalia, remain the property of their respective owners. Nothing in this EULA grants rights beyond the licence expressly stated here.

7. Privacy

The processing of personal data and the ways to exercise your rights are described in our Privacy Policy. Optional permissions, such as location or notifications, may be refused or withdrawn in your device settings, subject to the features available.

8. Updates, suspension and termination

We may update, modify, suspend or discontinue the App or any feature. We may also terminate the licence if you breach this EULA. This EULA ends when you uninstall the App as well. Provisions concerning intellectual property, liability limits, governing law and any other provision that by its nature should survive will continue to apply.

9. Warranties and liability

To the maximum extent permitted by law, the App is provided "as is" and "as available", without a guarantee of continuity, absolute accuracy, data availability or error-free operation. All mandatory consumer rights and warranties under applicable law remain unaffected.

To the extent permitted by law, MRK SOFTWARE is not liable for indirect damages, data loss or travel decisions based on inaccurate, incomplete or outdated information. Nothing in this EULA limits liability that cannot legally be excluded or limited, including liability for fraud or gross negligence where applicable.

10. Support

The App is developed and supported by MRK SOFTWARE, not by Apple or Google. For questions, complaints or claims about the App, contact us at mrk.devapps+support@gmail.com.

11. Clauses required for Apple distribution

This EULA is concluded solely between you and MRK SOFTWARE. Apple Inc. and its subsidiaries are not parties to this agreement and are not responsible for the App, its maintenance, support, product claims or regulatory compliance; those responsibilities belong to MRK SOFTWARE to the extent required by law.

You also agree to comply with applicable third-party terms when using the App. You represent and warrant that you are not located in a region subject to a U.S. Government embargo or designated as a terrorism- supporting region, and that you are not listed on a U.S. Government list of prohibited or restricted parties.

Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

12. Governing law and contact details

This EULA is governed by Italian law, without prejudice to mandatory consumer rights under European law and the law of the country where you reside.
